The amendment directed judges to consider public safety when setting cash bail, aiming to rectify unintended consequences of prior bail reform efforts and maintain Ohio's bail system's integrity. The change was precipitated by a bipartisan effort and involves collaboration across the legal community to quickly address the situation.
Lawmakers fast-tracked an amendment to overturn an Ohio Supreme Court decision and ensure that public safety could be considered in setting bail conditions. This was seen as a way to address concerns about crime and public safety, though it complicated ongoing bail reform efforts.
The approval of the cash bail amendment stripped Ohio courts of their rulemaking power under Article IV, Section 5, leaving all conditions of setting bail to the General Assembly. As a result, the Supreme Court of Ohio repealed Criminal Rule 46 to respect voters' decision.
The controversial addition to Ohio's bail considerations was "public safety," which was not previously included in the rule. This addition followed the DuBose decision, prompting the constitutional amendment.
The new legislation, while not resolving all questions surrounding bail, aims to provide some consistency and is seen as urgent to pass. The ACLU of Ohio supports codifying Rule 46 as a stopgap measure, pushing for further evidence-based policy changes to improve pretrial fairness and liberty.
