Colorado law mandates that the primary aim in setting bond amount and conditions is to ensure the defendant appears at the required time and place to answer the criminal charge​​.

Jurisdictions should adopt procedures to promote the release of defendants on their own recognizance or, when necessary, unsecured bond​​.

Release on financial conditions should be used only when no other conditions will ensure appearance. The court should consider the defendant's financial ability and not employ financial conditions to respond to public safety concerns​​.

The General Assembly aimed to reduce unnecessary pretrial detention by limiting the use of secured financial conditions of release, ensuring the use of best practices in bail administration​​.

Bail is now defined not just as a monetary amount but as a security which may include a bond with or without monetary conditions​​.

A fifth category of offenses for which bail may be denied was added, described by the Colorado Attorney General’s Office as “constitutionally suspect”​​.

Changes include more individualization of conditions, mandatory consideration of a defendant’s financial situation, and the presumption of release under least-restrictive conditions unless the defendant is unbailable​​.

The new statute lists four bond types, each defined by its restrictive nature, ranging from unsecured personal recognizance bonds to bonds secured by real estate​​.

This section contains all discretionary and nondiscretionary conditions of release, emphasizing that secured money at bail should not be automatic​​.

Defendants may file a motion for relief presenting evidence not fully considered by the bail setting judge within seven days after a secured bond is ordered​​.
